New York (CNN) – Under an agreement for shared custody, Mike Kibala gave his 2 year old daughter, Samantha, an officer during an exchange of visits scheduled to New Hyde Park Police Department in New York.

Kibala saying it was February 4, 2001, the last time we saw Samantha.

Kibala and his wife, Ann Yermak, were scheduled to appear next day in court for a divorce hearing. He never showed, and has not been seen since.

A psychiatrist appointed by the court had declared in a custody hearing earlier that future visits by Samantha with her mother should be supervised.

According to the psychiatrist, Yermak was found to show symptoms of Munchausen syndrome by proxy, a condition where a person attributes the disease to another person, often a child who is caring for, although the child ill.

“She continued taking Samantha to hospital when I leave for visits,” said Kibala. “Every time Samantha left her and she would tell the police that he abused her.”

“Munchausen by proxy would be the diagnosis, which is, of couryes, a terrible diagnosis dangerous in terms of the baby, due to a serious diagnosis that the baby is growing as a sick child, “said the psychiatrist, Dr. Bert Pepper, told CNN.

He added that a mother is often motivated by the attention she receives from others to take care of a child allegedly ill.

“What I found in the course of months of evaluation, is that the baby was perfectly healthy and was taking the baby to the doctor after doctor and medical care for diseases do not exist,” said Pepper. “None of the illnesses were confirmed by any of the pediatricians that I spoke.”

Kibala said the Court be granted custody after an investigation by child services ruled against the allegations of abuse were unfounded.

Kibala said it took a divorce, hiring and dismissal of over 20 lawyers.

He added that after his wife became pregnant, she used her credit card to purchase items intended for a child much more, including a motorized toy car.

“Maybe love is blind and not see the red flags,” said Kibala.

Investigators learned that in the weeks before his disappearance, had been loaded up Yermak prepaid cards at a convenience store.

Subsequently, Yermak stopped using his cell phone and credit cards.

Detective Pierce Redmond of the Office of Sheriff of Rockland County, was assigned to the case in 2003. He says the most likely scenario is that Yermak and Samantha have been living under false identities.

“In our time it is difficult to fly under the radar,” said Redmond. “Certainly, if you have a new identity that would make it easier. I can not imagine that you are using your name.”

Redmond said it would be difficult for Yermak to stay in the race without help. This assistance, the detective added, may come from family Yermak.

Although Yermak had been living with his mother, Ruth Yermak, when she and Samantha disappeared, Redmond said Ruth Yermak has provided little help to investigators.
